In his capacity as a member of the bar association council and then a former member of the bar association council, the author was one of the 14 delegates of the President of the Bar of Paris to contest the searches at the lawyer's premises between 2019 and 2023 With this article, he wants to share with his colleagues the way in which a search of the home and/or office of a lawyer takes place in practice. The author put himself in the shoes of a lawyer searched at her home and then at her office. Any resemblance to actual or actual persons is purely coincidental and unintentional.
To use the expression of the chairman Jean Lemaire, the law firm is a “sacred asylum” “in which no bailiff could act for the purposes of service” (in V. Nioré, cited above).
A search of a lawyer is always an intrusive act and very often a trauma for the latter. The searched lawyer is also often a humiliated lawyer who can break down or cry (in V. Nioré, Perquisitions chez l'avocat. Defense of secrets and inviolability of the sacred asylum, ed. Lamy Ax droit, 2014, p.34) .
