The draft bill transposing European Directive 2023/970 of May 10th, 2023, was submitted to social partners on March 6, 2026.

It aims to strengthen the application of the principle of equal pay for women and men by combating pay gaps.

The eight key changes are:

• The introduction of a requirement to inform job applicants of the salary range from the recruitment stage;

• The establishment of a new right to information regarding individual salary levels and salary levels broken down by gender for employees performing work of equal value;

• An adjustment to the burden of proof in cases of pay discrimination;

• A reform of the gender equality index and reporting requirements;

• The introduction of soft skills and working conditions to define the concept of "work of equal value";

• Differentiated responsibilities of the Works Council (CSE) depending on the company's workforce size;

• The implementation of financial penalties for employer non-compliance with obligations;

• After its promulgation, the law will take effect from a date to be set by decree, and at the latest within one year of its promulgation, although specific deadlines will be set for certain obligations.
