Intended audience: landlords, tenants, and real estate professionals involved in renting out residential property.
Purpose: the Act of July 6, 1989 on improving landlord-tenant relations requires that lease agreements be made in writing and comply with standard-form contracts. This decree amends the standard-form contracts applicable to unfurnished leases, furnished leases, and single-lease shared tenancies (colocation) for use as a primary residence. These changes are made pursuant to Act No. 2023-668 of July 27, 2023, aimed at protecting homes against unlawful occupation, which introduced a requirement that lease agreements include a termination clause in the event of non-payment of rent or charges, or failure to pay the security deposit. In addition, the optional grounds for a termination clause are expanded to include non-compliance with the primary-residence covenant set out in Article L. 151-14-1 of the Planning Code (Code de l'urbanisme), introduced by Act No. 2024-1039 of November 19, 2024, aimed at strengthening local regulatory tools for short-term tourist rentals. Finally, the text adds, in both standard-form contracts, an optional field for the landlord's and tenant's mobile phone numbers under the parties' identification section, intended in particular to allow tenants to be reached more quickly in order to help prevent evictions. It also corrects clerical errors found in Decree No. 2026-84 of February 12, 2026, on unpaid housing costs for recipients of personal housing assistance, issued pursuant to Act No. 2023-668 of July 27, 2023, aimed at protecting homes against unlawful occupation.
Entry into force: Article 1 of this decree enters into force on October 1, 2026 and applies to contracts signed or renewed as of that date. Article 2 of this decree enters into force on January 1, 2027.
Legal basis: this decree is issued pursuant to Articles 3, 4, 7, 8-1, 24, and 25-7 of Act No. 89-462 of July 6, 1989 on improving landlord-tenant relations.
