In a decision of the 2nd Civil Chamber of the Court of Cassation dated July 3, 2025 (No. 22-15.342) published in the Bulletin, the latter affirmed that no legislative or regulatory provision empowers the pre-trial judge (CME) to compel the parties, under penalty of being struck off the roll, to limit the number of pages of their pleadings, which would hinder the exercise of the right of appeal.

In this case, the case was struck off because one party had failed to comply with the order of the pre-trial judge of the Versailles Court of Appeal to summarize their pleadings within the 35-page limit. The Court of Cassation affirms that limiting the number of pages in the parties' submissions would hinder the exercise of the right of appeal.

In its decision of July 3, 2025, the Court of Cassation quashes and annuls the injunction decision of July 3, 2020, and the striking-out order of September 10, 2020, issued between the parties.

The Court of Cassation has called time on the game. This decision is to be welcomed.
