An employee who repeatedly makes sexually explicit, insulting and degrading remarks towards two of his female colleagues, which is likely to characterize, whatever the previous attitude of the employer who is bound by a safety obligation in terms of protecting the health and safety of workers, commits wrongful behavior constituting a real and serious cause justifying the dismissal decided by the employer.
This is what the Court of Cassation states in a decision of 12 June 2024 (no. 23-14.292) published in the bulletin.
