In a decision of  December 4th 2024 (no. 23-15.337) published in the bulletin, the Court of Cassation underlines the importance of the employer's diligence in managing cases of incapacity of an employee and established a new ground for judicial termination of the employment contract: the forced inactivity of the employee, independently of classic grievances such as loss of remuneration or being put on the back burner.

The judgment recalls that the prolonged maintenance of an employee in a situation of forced inactivity due to the slowness of an employer in managing the redeployment or dismissal of the unfit employee may constitute a serious breach of contractual obligations. This lack of diligence, when it forces the employee to refer the matter to the industrial tribunal, can legitimately result in the judicial termination of the contract due to the employer's fault.

This decision highlights the often overlooked consequences of such a lack of responsiveness on employment relations and the resulting obligation of good faith.
